OFAC SANCTIONS IRANIAN IRGC-QF AND HIZBALLAH FINANCIAL NETWORK

On 31 January, OFAC advised that it had sanctioned 3 entities and 1 individual located in Lebanon and Türkiye for providing critical financial support to an Iranian Islamic Revolutionary Guard Corps-Qods Force (IRGC-QF) and Hizballah financial network.  These entities have generated hundreds of millions of dollars’ worth of revenue from selling Iranian commodities, including to the Syrian government.  These commodity sales provide a key source of funding for the IRGC-QF and Hizballah’s continued terrorist activities and support to other terrorist organisations throughout the region.

OFAC TARGETS ENTITIES FUNDING THE CONFLICT IN SUDAN

On 31 January, OFAC advised that it had sanctioned 3 entities for their role in undermining the peace, security, and stability of Sudan.  These designations are said to signal the continued commitment of the US to identify and isolate funding sources for both the Sudanese Armed Forces (SAF) and the Rapid Support Forces (RSF), the 2 main belligerent parties responsible for the conflict in Sudan.  Designated are ALKHALEEJ BANK CO LTD, ZADNA INTERNATIONAL CO FOR INVESTMENT LTD, and AL-FAKHER ADVANCED WORKS CO. LTD.

OFAC SANCTIONS MILITARY CRONIES AND COMPANIES IN BURMA 3 YEARS AFTER MILITARY COUP

On 31 January OFAC advised that it was designating 2 entities closely associated with Burma’s military regime, as well as 4 cronies.  OFAC has coordinated this sanctions action to include individuals and entities that were previously designated by Canada in October.  It also issued General License 6: Authorizing the Wind Down of Transactions Involving Shwe Byain Phyu Group of Companies.

AML/CFT: FOURTH ROUND MUTUAL EVALUATION REPORT OF ST VINCENT AND THE GRENADINES

On 31 January, FATF-style regional body CFATF published this MER following the on-site visit conducted between 20-31 March 2023.  The report analyses the level of compliance with the FATF 40 Recommendations as well as the level of effectiveness of St Vincent and the Grenadines’ AML/CFT system and provides recommendations on how the system could be strengthened.

AML/CFT: MALI – FOURTH ENHANCED FOLLOW-UP REPORT

On 30 January, FATF published this Follow-up Report, prepared by FATF-style regional body GIABA.  It said that Mali has made significant progress in addressing the technical compliance deficiencies identified in its MER on Recommendations 2,6, 7, 8, 28 and 34.  As a result –

  • Recommendation 2 is upgraded from Partially Compliant to Largely Compliant;
  • Recommendation 6 is upgraded from Partially Compliant to Largely Compliant;
  • Recommendation 7 is upgraded from Partially Compliant to Largely Compliant;
  • Recommendation 8 is upgraded from Non-Compliant to Partially Compliant;
  • Recommendation 28 is upgraded from Non-Compliant to Partially Compliant; and
  • Recommendation 34 is upgraded from Partially Compliant to Compliant.

Mali now has 16 FATF Recommendations rated Non-Compliant/Partially Compliant.  Consequently, the country will remain under the enhanced follow-up system. Mali’s next Enhanced Follow-up Report is due in May.

AML/CFT: KYRGYZ REPUBLIC FOLLOW-UP REPORT

On 30 January, FATF published the Fifth Enhanced Follow-up Report for Kyrgyz, prepared by FATF-style regional body EAG.  It says that the country has made significant progress in rectifying the technical compliance shortcomings identified in the MER.  In terms of the amended FATF Recommendations following the on-site mission, the Kyrgyz Republic has significantly implemented the new R.15 requirements.  Following the follow-up Recommendation 8 has been re-rated from partially compliant to largely compliant; and Recommendation 15 has been re-rated from partially compliant to largely compliant.  The Kyrgyz Republic continues to be under enhanced monitoring and will continue to report to the EAG on future progress in improving the national AML/CFT system.
