NEW PLANS TO REPLACE UK GDPR

On 7 October, Simmons & Simmons reported that Michelle Donelan, the new Secretary for State for Digital, Culture, Media and Sport (DCMS), made a speech during the recent Conservative Party conference announcing a plan to replace the GDPR with a new “British data protection system”.  The article says that this announcement means that the Data Protection and Digital Information Bill, which is currently progressing through Parliament, is now likely to be abandoned

THE NEW EU-US DATA PRIVACY FRAMEWORK (DPF)

On 7 October, the Atlantic Council published a post about an Executive Order which is the next step toward establishing a new EU-US Data Privacy Framework (DPF), which will secure the free flow of personal data and thus underpins the US-EU commercial relationship.  It replaces the 2016 US-EU Privacy Shield agreement, which, according to the ECJ, failed to protect the EU citizens’ data from US government surveillance.
