UK IMPLEMENTS HUMANITARIAN EXCEPTION TO AFGHANISTAN SANCTIONS REGIME

On 28 January, the EU Sanctions blog reported that the UK has adopted the Afghanistan (Sanctions) (EU Exit) (Amendment) Regulations 2022, which establish a humanitarian exception to UK sanctions.  They reflect UN Security Council’s Resolution 2615, which created a humanitarian exemption to Taliban-related sanctions.

UK DELISTS 4 ENTRIES AND AMENDS 48 OTHERS ON IRAN SANCTIONS LIST

On 28 January, a Norice from HM Treasury advised that Ahmad ZARGAR; Hassan HADDAD; Mohammad HEJAZI; and Seyyed Hasan FIRUZABADI have been removed from the sanctions list, and the existing entries for 48 more have been amended.

A GUIDE ON ADDRESSING CORRUPTION IN THE FISHERIES SECTOR

A report from the UN Office on Drugs & Crime was developed with generous funding from the Norwegian Agency for Development Cooperation (Norad) under the framework of the FishNET project, which is jointly implemented by the Global Programme on Wildlife and Forest Crime (GPWLFC) and the Global Programme for Container Control (CCP) of UNODC.  It says that corruption is an endemic problem undercutting the fight against fisheries crime.  It says that the global fishing industry directly employs over 59.6 million people, and the long-term viability of the industry requires a fair global market.  To protect blue economies and those that work within them, it is imperative that the fishing industry itself becomes an advocate for stamping out corruption, and that Governments worldwide focus on strengthening preventive measures that will address identified corruption risks.  The guide provides a step-by-step process for fighting corruption in the fisheries sector.

HEWLETT-PACKARD WINS MAMMOTH HIGH COURT CLAIM AGAINST THE FORMER EXECUTIVES OF UK SOFTWARE COMPANY AUTONOMY FOLLOWING THE UK’S BIGGEST CIVIL FRAUD TRIAL

On 28 January, the Law Society Gazette reported that, after a high-profile trial which began in March 2019 and sat for nearly 100 days, the judge has announced that ’the claimants have substantially succeeded in their claims in these proceedings’.  It is said that the damages will likely be ’considerably less’ than the $5 billion claimed by HP.  The Home Secretary is deciding whether to approve the extradition of founder and chief executive Mike Lynch, 56, to face 17 criminal charges, including wire and securities fraud, in the US over HP’s acquisition of Autonomy.  Meanwhile, chief financial officer Sushovan Hussain, 57, is currently serving a 5-year jail sentence in the US.

EU DELETES KHALIL BEN AHMED BEN MOHAMED JARRAYA FROM ISIL/AL-QAIDA SANCTIONS LIST

EU Regulation 2022/117/EU has formally removed Khalil Ben Ahmed Ben Mohamed Jarraya from its sanctions lists, following the decision of the relevant UN Sanctions Committee on 24 January.

EU AMENDS 3 ENTRIES UNDER TUNISIAN SANCTIONS REGIME

EU Regulation 2022/113/EU has replaced 3 entries on the list of those subject to the EU Tunisian sanctions regime.  At the same time and the information relating to the application of the rights of defence and right to effective judicial protection under Tunisian law is also amended.
