FORMER PRIME MINISTER OF TURKS AND CAICOS ISLANDS IS ON BRINK OF WALKING FREE AS 6-YEAR £75 MILLION CORRUPTION TRIAL IS HALTED

On 13 February, the Daily Mail reported that the former prime minister of the Turks and Caicos Islands is on the brink of walking free after his 6-year corruption trial was halted following the death of its judge.  Michael Misick, 55, resigned as premier of the islands, which is a British Overseas Territory, in 2009, after a UK commission found a ‘high probability of systemic corruption’.  The former premier, who has attracted celebrities including Michael Douglas to the islands, fled to Brazil but was extradited in 2014.  However, the future of the investigation is now uncertain following the death of Mr Justice Paul Harrison, 84, who died at his home in Jamaica.

GIBRALTAR: COUNTER TERRORIST FINANCING GUIDANCE NOTES

The Gibraltar FIU has published these Guidance Notes which aims to provide entities with guidance on their countering terrorism financing obligations and sector specific guidance on the terrorism financing threats they face.  It includes a description of how the FIU will provide local contextual information and provide feedback to reporting entities on their SAR.  It is said to take into account the 2020 National Risk Assessment for AML/CFT/CPF.  Among other things, it contrasts the flow of funds with that in money laundering.

US: COMMERCE DEPARTMENT AMENDS THE EXPORT ADMINISTRATION REGULATIONS TO IMPLEMENT REVISED UNMANNED AERIAL SYSTEM LICENSING REVIEW POLICY

On 13 February, an article from Baker McKenzie said that on 12 January, the Department of Commerce issued a final rule amending the Export Administration Regulations (EAR) to implement recent licensing review policy changes for exports of US-origin UAS (aka drones).  Certain UAS covered by Category I of the Missile technology Control regime (which were subject to a strong presumption of denial) would be treated as though such UAS were covered by MTCR Category II (which are subject to a more flexible case-by-case review policy for export licensing purposes).   The licensing review policy changes implemented by the Final Rule are motivated by the rapid evolution of UAS technology in recent years.

FinCEN ADVISORY PUTS FINANCIAL INSTITUTIONS ON NOTICE FOR RED FLAGS INDICATIVE OF COVID-19 RELATED HEALTH CARE FRAUD

On 11 February, an article from Clifford Chance says that financial institutions are expected to identify potential indicators of pandemic-related fraud involving the health insurance and health care industries.  On 2 February FinCEN laid out numerous red flags in an Advisory and directed financial institutions to be on the lookout for these scenarios.

On 12 February, Yahoo News reported that, while revoking the designation of Yemen’s Houthi movement, and reversing a policy imposed in the final days of the Trump Administration, the US will not be lifting sanctions on some members of its leadership.  3 Houthi leaders will remain designated.

PANAMA DE-FLAGS 5 TANKERS FOR SANCTIONS-EVADING PRACTICES; TOGO ANOTHER

On 12 February, Lloyds List reported that Panama is removing 5 tankers and investigating a further 17 which had missing vessel-tracking signals. It also mentioned that the Togo registry is cancelling the flag of an Aframax tanker involved in ship-to-ship transfer of Iranian crude.
