ALGERIA: FORMER CAR INDUSTRY BOSS GETS 16-YEAR JAIL TERM FOR CORRUPTION

On 15 July, the Jordan Times reported that Mahieddine Tahkout, a former car industry boss who amassed riches under Algeria’s ousted president Abdelaziz Bouteflika has been sentenced to 16 years in prison on corruption charges.

US DoJ SEEKS RECOVERY OF APPROXIMATELY $3.5 MILLION IN CORRUPTION PROCEEDS LINKED TO EX-PRESIDENT OF THE GAMBIA

A news release from the DoJ on 15 July advised that it had filed a civil forfeiture complaint seeking the forfeiture of a Maryland property acquired with approximately $3,500,000 in corruption proceeds by the ex-president of The Gambia, Yahya Jammeh, through a trust set up by his wife, Zineb Jammeh.

US AND 6 MIDDLE EAST STATES JOINTLY TARGET 4 ENTITIES AND 2 INDIVIDUALS FOR SANCTIONS

On 15 July, the US Treasury announced that the 7 member nations of the Terrorist Financing Targeting Center (TFTC) – Saudi Arabia, Bahrain, Kuwait, Oman, Qatar, and UAE – have jointly designated –

  • 6 targets affiliated with the ISIS – 3 entities and 1 individual located in Turkey and Syria have provided a critical financial and logistical lifeline to ISIS, its branches, and its global facilitation networks; and
  • an Afghanistan-based organisation, Nejaat Social Welfare Organisation, and its director, Sayed Habib Ahmad Khan, abused the goodwill of the international community under the auspices of charitable giving to facilitate the transfer of funds for and to support the activities of ISIS’s branch in Afghanistan, ISIS-Khorasan (ISIS-K).

Since its inception in 2017, the TFTC has issued 5 rounds of joint designations against over 60 terrorist individuals and entities with designations targeting a wide range of terrorist organisations, including ISIS and its affiliates, al-Qa’ida, the IRGC, Lebanese Hizballah, and the Taliban. It is said that this action targets 3 significant money services businesses: al Haram Exchange, Tawasul Company, and al-Khalidi Exchange. These are said to have have played a vital role in transferring funds to support Syria-based ISIS fighters and have provided hundreds of thousands of dollars of liquidity to ISIS leadership.

OFAC ADDS 3 INDIVIDUALS AND 5 ENTITIES TO SANCTIONS LISTS

On 15 July, OFAC announced that 3 individuals (Russian, but one German-born and one with a St Kitts & Nevis passport) and 5 entities (3 Hong Kong, 1 Russian, 1 Sudanese) had been added to its sanctions lists.  The listings were connected to ongoing efforts regarding financier Yevgeniy Prigozhin, by targeting entities located in Sudan, Hong Kong, and Thailand that have enabled his ability to evade US sanctions.

US IMPOSES VISA RESTRICTIONS ON CERTAIN CHINESE TECH COMPANIES EMPLOYEES, INCLUDING OF HUAWEI

A news release from the US State Department on 15 July advised that the restrictions were imposed as those employees of Chinese technology companies allegedly “provide material support to regimes engaging in human rights abuses globally”. Companies impacted include Huawei, described as an arm of the Chinese Communist Party’s surveillance state that censors political dissidents and enables mass internment camps in Xinjiang and the indentured servitude of its population shipped all over China.  Certain Huawei employees are said to provide material support to a regime that commits human rights abuses.

THE UK SUPREME COURT, THE DPA AND MUTUAL LEGAL ASSISTANCE – AND BREXIT

On 15 July, a blog post from Corker Bining looked back at a Supreme Court unanimous ruling that the Home Secretary had acted unlawfully in providing to the US authorities mutual legal assistance – in the form of the product of UK police enquiries – which would be used to facilitate the prosecution of offences carrying the death penalty. The Court declined to establish a common law principle that facilitation of the death penalty through the provision of MLA is unlawful – but rather, unlawfulness arose from the failure to take into account the provisions of the Data Protection Act 2018 concerning the transfer of personal data to third countries.  This post explores the consequences of this judgment, not just for death penalty cases, but for all cases in which the provision of MLA to an overseas prosecutor engages the DPA – but cautions that, as the DPA implements EU law, Brexit may change things. It concludes by warning that, in the hands of an unprincipled Secretary of State, a new-found freedom from the EU could become a recipe for yet more criminal justice decisions motivated by political expediency.

UN GLOBAL STUDY ON FIREARMS TRAFFICKING 2020

On 15 July, the UN Office on Drugs and Crime published this Study, based on data of more than 100 countries and territories providing a unique insight into the flows and modalities of illicit firearms trafficking. Among the topics addressed are –

  • firearms seizures across the world, focusing particularly on the magnitude and location of seizures, as well as the types of firearms that are most frequently seized;
  • the nature of firearms trafficking, including the prices paid for firearms in illicit markets, modalities of illicit firearms trafficking across international borders and within countries, and trafficking within some selected countries with known, sizable domestic firearms trafficking flows; and
  • the regional dimensions of firearms trafficking (Africa, Americas, Europe, Asia and Oceania).

UK WELCOMES ANNOUNCEMENTS BY 8 OVERSEAS TERRITORIES – BUT NOT BVI – RE BENEFICIAL OWNERSHIP

A news release from HM Treasury on 15 July advised that 8 Overseas Territories are to introduce publicly-accessible registers detailing who owns the companies in their Territory. The UK Overseas Territories which have committed to implement this measure are; Anguilla, Bermuda, Cayman Islands, the Falkland Islands, Montserrat, the Pitcairn Islands and St Helena, Ascension Island and Tristan da Cunha, and the Turks and Caicos Islands. Hm Treasury says that the UK has led an international campaign to make such registers a global norm by 2023 and is hopeful the only remaining permanently inhabited territory not to make an announcement, the BVI, will make a similar commitment soon.
