NEW EU REGULATION ON THE MARKETING AND USE OF EXPLOSIVES PRECURSORS

EU Regulation 2019/1148/EU revokes and replaces Regulation 98/2013 and amends Regulation 1907/2006.  The 2013 Regulation established harmonised rules concerning the making available, introduction, possession and use of substances or mixtures that could be misused for the illicit manufacture of explosives, with a view to limiting their availability to the general public, and ensuring the appropriate reporting of suspicious transactions throughout the supply chain.  The new Regulation revokes and replaces the 2013 Regulation because it is necessary to strengthen the system of controls on precursors that can be used for manufacturing homemade explosives, with differing controls in individual Member States contributing to the threat posed by homemade explosives remaining high and it continues to evolve.  The system is to be further strengthened and harmonised in view of the evolving threat to public security caused by terrorism and other serious criminal activities, and should also ensure the free movement of explosives precursors in the internal market.  The new Regulation will apply from 1st February 2021.
